DISCLAIMER

1          Neither Swire Properties Limited (SPL) nor any other party involved in creating, producing, or delivering the ePM shall be liable for:-

(a)        Any costs, losses, expenses or damages whether direct or indirect;

(b)        Special, incidental or consequential damages; or

(c)        Loss of profits, business revenue or goodwill.

           arising out of the User’s use or access of or inability to use or access, interruption or availability of the ePM, its operation or transmission, computer viruses, loss of data, reliance on information contained on the ePM or otherwise in respect of its use.

2          SPL does not warrant that the functional aspects of the ePM will be uninterrupted, timely or error free or that this ePM or the server that makes it available are free of viruses or other harmful components.   Without limiting the foregoing, and to the fullest extent permitted by law, the ePM and its contents are provided to the User “as is” without representations or warranties of any kind.

3          SPL does not warrant or represent that Information accessible via the ePM is accurate, complete, correct or up to date.

4          Whilst SPL will make every effort to ensure that the ePM is a secure medium of communication, SPL cannot guarantee the security of any Information posted on the ePM or otherwise sent to SPL on the Internet.  SPL is not, and will not be, responsible for any damages the User may suffer as a result of the loss of confidentiality of any such Information.

5          Nothing in this paragraph 4 shall exclude or limit:

5.1       The liability of SPL for death or personal injury arising from the negligence of SPL or any of its officers, employees or agents; or

5.2       Any other liability which SPL is prohibited from excluding or limiting, as the case may be, by law.
